Many Americans like you are being contacted by collection agencies who are trying to get payments on defaulted accounts they have acquired or been assigned. Even though you may owe a debt, you still have rights.

You should dispute the debt in writing if you feel as if the dollar amount the collection agency is requesting is inaccurate, if you feel the debt is not owed or if you feel the debt is fraudulent. You can send a letter to the collection agency within thirty days of first being notified of the collection. You should send this letter via certified mail so that you can prove that they received it. In response to your dispute, the collection agency must cease collection activity until they send you some sort of validation of the alleged debt. They can resume their collection efforts again once they produce proof of your debt.

The Fair Debt Collection Practices Act (“FDCPA”) regulates what debt collection agencies may and may not do. There are many things collection agencies cannot do or say when contacting you. Collection agencies may not:

  • use abusive or obscene language;
  • call before 8am or after 9pm;
  • call you repeatedly;
  • call you at work, if they know that your employer does not permit personal calls;
  • contact any third party and state that you owe a debt;
  • threaten to have you arrested or imprisoned.

    If any of these things occur, your best option is to consult with a consumer protection attorney.

      Williams Charles and Scott is a company that collects defaulted debt. Williams Charles and Scott will count a consumer’s ignorance to collect more than a person owes.

      I got a call from an “Investigator” Mark Sloan at Williams, Charles & Scott. Mark Sloan at Williams, Charles & Scott left a message stating I had two civil actions pending against me in the county where I live. Mark Sloan at Williams, Charles & Scott said I had to call to prevent further legal action. I called back and Williams, Charles & Scott said that I had an old credit card debt of $10,000.00 and that they were going to have the Sheriff come to my house and arrest me, that I would be summoned to court to pay and then I would have to pay about $5,000.00 in legal fees on top of that! Williams, Charles & Scott said my name would be published in the paper and that the top of my credit report would show that I had to be sued for the money. I was so terrified that I gave them my bank account information over the phone and authorized a post-dated check by phone on payday. Williams, Charles & Scott told me if my check bounced I would be arrested!

      I was called, as well as my administrator, by Scott Weiss, President of Williams Charles Scott. The call threatened us with “repercussions” in the event we failed to heed his demand. Threats made over the phone are illegal, Scott doesn’t seem to care. We will be filing a complaint against the WCS and the firm on whose behalf WCS is attempting to collect a debt.

      Williams Charles and Scott – Truly terrible man. Used profanity and harassment calling numerous times in a row.

      Absolutely the most unprofessional organization I have ever dealt with. I was sworn at and asked to get someone above my “pay grade”. The harassing continuous calls sometime over 10 a day were verbally abusive and threatening. I hope to get the word out of the unethical business practices.

      Scott called my employer in regards to someone else’s unsettled debt that my name was not attached to. He did not ask for me, but asked for “whoever is in charge”. I work at a car dealership, there are a lot of higher up’s. I am one of the sales managers so I said I am the one in charge today. He then started screaming and told me he was going to find out where I sleep, and my personal phone number to harass me even more, and if I don’t send him $17,000 he is going to rape my wife and kids, and afterwards call every minute of every day until he gets 17 grand. After his temper tantrum he asked if he stuttered then hung up. How is this place still in business?
