Many Americans like you are being contacted by collection agencies who are trying to get payments on defaulted accounts they have acquired or been assigned. Even though you may owe a debt, you still have rights.

You should dispute the debt in writing if you feel as if the dollar amount the collection agency is requesting is inaccurate, if you feel the debt is not owed or if you feel the debt is fraudulent. You can send a letter to the collection agency within thirty days of first being notified of the collection. You should send this letter via certified mail so that you can prove that they received it. In response to your dispute, the collection agency must cease collection activity until they send you some sort of validation of the alleged debt. They can resume their collection efforts again once they produce proof of your debt.

The Fair Debt Collection Practices Act (“FDCPA”) regulates what debt collection agencies may and may not do. There are many things collection agencies cannot do or say when contacting you. Collection agencies may not:

  • use abusive or obscene language;
  • call before 8am or after 9pm;
  • call you repeatedly;
  • call you at work, if they know that your employer does not permit personal calls;
  • contact any third party and state that you owe a debt;
  • threaten to have you arrested or imprisoned.

      Western Mercantile Agency Inc is really unprofessional. Western Mercantile Agency Inc started refusing payments from me. I have been making these payments to Western Mercantile Agency Inc for years. All the sudden my payments are unacceptable to Western Mercantile Agency Inc.

      First I would like to say, Thank you Western Mercantile. My husband and I have only $225 to live off of for and entire month now that you decided to garnish his wages instead of talking with us about the bill that I am not responsible for since it was not billed to my insurance during my hospital visits, and the hospital did not follow up with me either. I hope you are happy that you can afford those nice vehicles and $1800/month salaries when you are literally taking money from people who can barely eat. Agencies like you buy these debts for cents on the dollar from the hospital and turn it around to make a profit. Isn’t that was Pawn Stores do? But instead, it’s with human lives. I have literally wanted to kill myself because of not only how bad the medical and insurance system is, but also because you wouldn’t even give us a chance to look into what could be done about the error, and placed undue duress upon me.

      This company, and many others like it do not help with debt. They are profiting off of people who are in debt, and force them to pay sums that can ruin their likelihood. Even if it was the mistake on behalf of the hospital or banking institution. It doesn’t matter. Even if you try to correct their mistake, it doesn’t matter.
