Fast Fact: Pursuant to the Fair Debt Collection Practices Act, a collection agency must tell you how much you owe, the name of the creditor to whom the debt is owed, and that you have the right to dispute the debt within thirty days.

Many Americans like you are being contacted by collection agencies who are trying to get payments on defaulted accounts they have acquired or been assigned. Even though you may owe a debt, you still have rights.

You should dispute the debt in writing if you feel as if the dollar amount the collection agency is requesting is inaccurate, if you feel the debt is not owed or if you feel the debt is fraudulent. You can send a letter to the collection agency within thirty days of first being notified of the collection. You should send this letter via certified mail so that you can prove that they received it. In response to your dispute, the collection agency must cease collection activity until they send you some sort of validation of the alleged debt. They can resume their collection efforts again once they produce proof of your debt.

The Fair Debt Collection Practices Act (“FDCPA”) regulates what debt collection agencies may and may not do. There are many things collection agencies cannot do or say when contacting you. Collection agencies may not:

  • use abusive or obscene language;
  • call before 8am or after 9pm;
  • call you repeatedly;
  • call you at work, if they know that your employer does not permit personal calls;
  • contact any third party and state that you owe a debt;
  • threaten to have you arrested or imprisoned.

    If any of these things occur, your best option is to consult with a consumer protection attorney.

      I defaulted on student loans about 4-5 years ago because I had trouble finding a job. I have not missed one single payment in over 2-3 years now and yet I still have to deal with people like this….
      I received a letter that my account was transferred to Transworld Systems Inc. It was very general and did not have a lot of information. I have called many times to try to understand what account(s) they have and how this will impact my previously arraigned payment plan. Sometimes, I am transferred to an answering machine that says to leave a message and then the mailbox if full. Other times I just have to wait and wait and wait and there is a recording that says thank you for holding, please remain on the line and your call will be answered in the order it was received…but no one ever comes to the phone. At times, I have waited over an hour (while at work) to try and reach someone. I just need to speak with someone who can provide me details behind the letter. There has to better company than Transworld Systems to deal with.

      I got several charges on a credit card bill from Transworld Systems, without my permission. My credit card company removed the charges from Transworld Systems and agreed that these were fraudulent.

      Transworld Systems Inc sent me a letter demanding $322.00 without any itemization. A more detailed bill was not available on Transworld Systems Inc’s website despite what the collection letter said.

      I received a debt collection from Transworld Systems Inc. It is for a debt that was never incurred. It is for a commercial lighting company in Tampa, Florida that is fake and just started calling our office one day saying we owed money when we have never had a need to order light bulbs. It is funny. The debt is for $318.02

      We will not pay but the fact they are collecting on fraud debt in the first place is crazy.

      Transworld Systems Inc is calling me from 8662297834, 8662730169, 8663765647, and 8663819807. Transworld Systems Inc does not leave a message and I don’t talk to them unless I accidentally pick up.
