Many Americans like you are being contacted by collection agencies who are trying to get payments on defaulted accounts they have acquired or been assigned. Even though you may owe a debt, you still have rights.

You should dispute the debt in writing if you feel as if the dollar amount the collection agency is requesting is inaccurate, if you feel the debt is not owed or if you feel the debt is fraudulent. You can send a letter to the collection agency within thirty days of first being notified of the collection. You should send this letter via certified mail so that you can prove that they received it. In response to your dispute, the collection agency must cease collection activity until they send you some sort of validation of the alleged debt. They can resume their collection efforts again once they produce proof of your debt.

The Fair Debt Collection Practices Act (“FDCPA”) regulates what debt collection agencies may and may not do. There are many things collection agencies cannot do or say when contacting you. Collection agencies may not:

  • use abusive or obscene language;
  • call before 8am or after 9pm;
  • call you repeatedly;
  • call you at work, if they know that your employer does not permit personal calls;
  • contact any third party and state that you owe a debt;
  • threaten to have you arrested or imprisoned.

      I have been harassed daily by Tate & Kirlin for credit card debt that was established when I was married. Tate & Kirlin calls several times daily and threatens me for non payment. I live only on disability payments. On a recent call, I was threatened with being served with legal papers if I didn’t set up payment arrangements. They have threatened me to the point of panic attacks.

      I had numerous bills that an ex had left me stranded with over eight years ago. All of a sudden I receive a letter from Tate and Kirlin Associates saying my account from one of these bills has been sold to them. I contacted my bank immediately and recovered the check that was used to pay this bill over eight years ago. I have tried faxing this proof to Tate and Kirlin Associates and they keep telling me they are not receiving it. I have also mailed a copy of this proof to Tate and Kirlin Associates and conveniently they haven’t received it there either. This is absolutely ridiculous. Tate and Kirlin Associates has 59 complaints with the Better Business Bureau. I’m about to be number 60.

      Everyone at Tate and Kirlin Associates hangs up when you start talking. Run as far as you can when Tate and Kirlin Associates start calling.

      I let this “professional” from Tate & Kirlin Associates rip into me for being a “deadbeat” because I’m on the lung transplant list and can’t work or do anything for that matter. I understand Tate & Kirlin Associates are doing a job but there are many other collection agencies that have been working with my situation. I am willing to accept responsibility for my debt, but this company wants their money which right now, and will resort to name calling and harassment.

      My credit report from Experian shows a new entry from Tate and Kirlin Associates. The original account was to be off my credit at the end of this year. It appears Tate and Kirlin Associates purchased the account and have re-aged it. Now it says that it is to be on my credit until the end of 2016.

      Identity theft is to blame for an alleged debt due to Tate and Kirlin Associates. Tate and Kirlin Associates of course does not have my correct information because the account is not mine. Tate and Kirlin Associate continues to report on my credit.
