Many Americans like you are being contacted by collection agencies who are trying to get payments on defaulted accounts they have acquired or been assigned. Even though you may owe a debt, you still have rights.

You should dispute the debt in writing if you feel as if the dollar amount the collection agency is requesting is inaccurate, if you feel the debt is not owed or if you feel the debt is fraudulent. You can send a letter to the collection agency within thirty days of first being notified of the collection. You should send this letter via certified mail so that you can prove that they received it. In response to your dispute, the collection agency must cease collection activity until they send you some sort of validation of the alleged debt. They can resume their collection efforts again once they produce proof of your debt.

The Fair Debt Collection Practices Act (“FDCPA”) regulates what debt collection agencies may and may not do. There are many things collection agencies cannot do or say when contacting you. Collection agencies may not:

  • use abusive or obscene language;
  • call before 8am or after 9pm;
  • call you repeatedly;
  • call you at work, if they know that your employer does not permit personal calls;
  • contact any third party and state that you owe a debt;
  • threaten to have you arrested or imprisoned.

      They called me and told me they had a man waiting to meet me to serve me with court documents. They said if I settled for 5 payments, the first of 310 then the rest of 410 my debt will be settled. I was so scared that I paid the first payment and I was told I would get a receipt in the mail as well as the documentation outlining the agreement. Its been a week and I have received nothing.

      They have been harassing me saying they have court papers and saying that I’m the defendant but they have not sent any official document.

      They called me on behalf of Ace Check Cashing which I know is a debt I owed. They pretty much threatened to come to my job and all sorts of things. I started making payments to them and I tried to contact them a couple of times since but have not gotten in touch with them since.

      I was contacted several times by Secure Capital Management stating I owed a debt. Each time its been to a different lender, and this debt was listed in my bankruptcy. During one of the first calls I got, the person said “this was not in your bankruptcy.” I had not even mentioned my bankruptcy at all. They keep calling and telling me that they have court papers to serve on me. Seriously, there is no process server that is going to call the person first and tell them that they are going to be served. I need to get them to quit harassing me.

      I have a situation where they want me to make payments for $25.00 every month starting this month. But they don’t send me proof that I owe the debt. What should I do? I need advice please. Starting tomorrow they’re taking out of my debit card $25.00 every 31st of the month. I need advice.

      I’ve had money deducted from my checking account for $19.95 for a number of months now. The transaction simply says “check” with no details. My bank gave the information they have, which gives the company name Secure Capital Management and a phone number 844-238-6019. I never authorized this deduction from my account and the bank will not help me put a stop to the deduction. They tell me I must contact the number and have them stop with withdrawal.

      Been receiving harassing phone calls from this company for MONTHS. Calls from different numbers, different states, all hours of day and night even while at work. Callers claim to be members of law enforcement or PIs hired by the company (never tells the company name) to investigate and serve me papers. When I ask, they are never at liberty to discuss that information. One guy calls ups and makes lewd, disgusting sounds on phone. Every time he does I hang up, and he will call back and leave them on my voicemail. He told me if I just took the papers, the harassment will cease. Recently lost my job due to stress from their constant calls and harassment (I take medication for bipolar disorder which I even explained to an idiot one day who called while I was at work one day, and he replied that did not concern him). Spoke to Sean who called recently after repeated begging for the calls to cease (512)982 1463. He stated the same as above; I told him that I would turn him into local law enforcement if he tried to show up to my address. He asked me not to call the police; then he stated that he would bring his own uniformed officer. I continued to inquire of who he was and what company he represented, he screamed at me not to play crazy, and said that I knew exactly what he was talking about. How could I know when he would never tell me?

      Called and said he was a courier and needed to setup a time to deliver legal documents to me. Requested me to call him back to verify my address. I then realized he was fishing for info. Called from 512-982-1470.

      Secure Capital Management called me from 8558958956 and left a message on my cell phone. A “process server” from Secure Capital Management also called my mother wanting to know how to reach me. I called back and Secure Capital Management informed me that they had fraud charges against me regarding a pay day loan. So here’s my question. Why would a collection agency need to “serve” me in an alleged criminal matter? If there were a criminal matter, they would arrest me. No one would be “serving” me. Do not be fooled by these lies and attempts to intimidate.

      SECURE CAPITAL MANAGEMENT 844-2386019 NY withdrawals from my bank statement for monthly payments. Still awaiting emails of payment and payment plan. They also said they would serve me if i didnt pay up.

      First my Mother received the call from the “process server” at Secure Capital Management who wanted to know how to reach me. This “process server” at Secure Capital Management then left a message on my cell phone. I called back and when he returned my call the next day he informed me that some company had fraud charges against me and he was attempting to serve me.

      My husband canceled payments with secure capital after seeing bad reviews. He went to jail Saturday morning to sit. I get a call today, monday, saying if he doesn’t continue payments they’ll have him serve time for not paying. The 213.00 he already paid will be taken as his lost and put towards fees for their services. Names are mike/ Nick from 5129821481.

      I currently owe on a past due loan an now I have people calling me saying I better pay up or I will be served in court. I do not know what to do to settle this matter. My biggest fear is making payments to a fraud company and never receiving any proof of payment or further info stating every detail about my balance due.
