Santander Consumer USA Inc is a company that offers a wide array of lending options. Many Americans like you are being contacted by collection agencies hired by Santander Consumer USA Inc who are trying to get payments on defaulted accounts.     The Fair Credit Reporting Act (“FCRA”) regulates the credit bureaus’ responsibilities as to your credit report. There are many things credit bureaus are required to do as it pertains to their credit reporting. Credit Bureaus must:

  • report accurately;
  • conduct a reasonable investigation of any dispute you make with them as to inaccurate credit reporting;
  • clearly mark any trade line disputed by you as disputed by the consumer.

      My daughter made her first car purchase through Santander Consumer USA Inc. When it came time for her first payment, I was present with her when the payment was made to Santander Consumer USA Inc by phone through the automated service. We monitored the account and when the funds were still in the account after the due date, we inquired as to why. We were told by the representative at Santander Consumer USA Inc that it was their error and that they pulled the funds and placed them back into the account. Later, I was informed that we had not previously made the payment to Santander Consumer USA Inc and that we were being charged the late fee. I spent almost 40 minutes with the supervisor at Santander Consumer USA Inc trying to straighten this out and still was told we would have pay $44 in fees. This is a first payment on a new auto loan with Santander Consumer USA Inc and the payment was made on time. The supervisor at Santander Consumer USA Inc was very uncaring, hard-nosed and refused to admit error in the situation that the previous representative did.
