Fact: Pursuant to the Fair Debt Collection Practices Act, it is unlawful for a collection agency to contact you via telephone if the collector receives written communication stating that you want the collector to stop calling you.

Many Americans like you are being contacted by collection agencies who are trying to get payments on defaulted accounts they have acquired or been assigned. Even though you may owe a debt, you still have rights.

You should dispute the debt in writing if you feel as if the dollar amount the collection agency is requesting is inaccurate, if you feel the debt is not owed or if you feel the debt is fraudulent. You can send a letter to the collection agency within thirty days of first being notified of the collection. You should send this letter via certified mail so that you can prove that they received it. In response to your dispute, the collection agency must cease collection activity until they send you some sort of validation of the alleged debt. They can resume their collection efforts again once they produce proof of your debt.

The Fair Debt Collection Practices Act (“FDCPA”) regulates what debt collection agencies may and may not do. There are many things collection agencies cannot do or say when contacting you. Collection agencies may not:

  • use abusive or obscene language;
  • call before 8am or after 9pm;
  • call you repeatedly;
  • call you at work, if they know that your employer does not permit personal calls;
  • contact any third party and state that you owe a debt;
  • threaten to have you arrested or imprisoned.

    If any of these things occur, your best option is to consult with a consumer protection attorney.

      firm is trying to collect $1400 today or seizure of bank accounts assets and threatened to take to court if i didn’t pay them on the phone immediately. Became very rude when I questioned them because I do not owe any money Dex has sent me a renewal of my contract with no balance due. They said they would fax me what statements I owed and all I got was a letter stating the same threats that were on the phone with a balance due within 5 days or seizure of all my assets not to be returned until after court case.

      I was contacted by Johnnie Richards from the number 1-888-705-4036. They called me at my place of employment regarding a bill for around $1800.00 for Yellow pages advertising. I told them I do not own my own business so this could not be me. They then told me that it was for a company I worked for over 3 years ago which has recently gone out of business. I was their office manager at the time and told me my name was on the contract. I told her again I no longer worked for that company. I have no idea how they got my current work number as it is not advertised anywhere and you have to go through a call center to reach me. Then she tried to ask me information about the employer that they should have on file if they were legitimately calling about a debt. I have had other customers with the same scam from the same person.

      Did anything become of their threats? I received the same threatening email saying they can subpoena all records, including checking accounts and tax records in order to locate hidden or unreported profits. If records found, they CAN file to seize bank accounts. I don’t think that is legal in the state of Texas. though. It definitely scare me at first until I started reading their tactics.

      Rude and unprofessional… Had the same “Good Luck In Court” comment made. This was a return call from an 800 number I called to find out “who” in their legal department I could contact regarding the alleged debt and their collection practices. The direct number was apparently “forwarded” to an individual and not a “company” so I hung up.

      The call was returned by a rude, unprofessional hack for a person and if this is the type of employee that represents the company then I am not certain how on earth they stay out of court.

      She defamed me as being “a deadbeat” and wanted to know when she was getting “her” money…all this as she was literally screaming at me.

      This woman was not even the person assigned to this account, but I simply wanted a name and number of an executive of the company so that my attorney could contact them regarding their collection procedures. She stated that she would have her attorney contact ME, called me stupid then said “Good luck in court”. that must be a scare that they use.

      They actually had the gall to call my company and discuss with an employee the status of the debt. I then sent an email and told my rep not to call me and the store and that I only want communication via mail. Guess what… they called again and threatened the fact their attorney would be given the file on the 19th…
