Many Americans like you are being contacted by collection agencies who are trying to get payments on defaulted accounts they have acquired or been assigned. Even though you may owe a debt, you still have rights.

You should dispute the debt in writing if you feel as if the dollar amount the collection agency is requesting is inaccurate, if you feel the debt is not owed or if you feel the debt is fraudulent. You can send a letter to the collection agency within thirty days of first being notified of the collection. You should send this letter via certified mail so that you can prove that they received it. In response to your dispute, the collection agency must cease collection activity until they send you some sort of validation of the alleged debt. They can resume their collection efforts again once they produce proof of your debt.

The Fair Debt Collection Practices Act (“FDCPA”) regulates what debt collection agencies may and may not do. There are many things collection agencies cannot do or say when contacting you. Collection agencies may not:

  • use abusive or obscene language;
  • call before 8am or after 9pm;
  • call you repeatedly;
  • call you at work, if they know that your employer does not permit personal calls;
  • contact any third party and state that you owe a debt;
  • threaten to have you arrested or imprisoned.

      I was contacted by Pinnacle Asset Group. They claimed I owe $3000. I asked the rep at Pinnacle Asset Group to send validation of this alleged debt. The rep at Pinnacle Asset Group said it will cost me money to get the validation. The rep at Pinnacle Asset Group also threatened to put a lien on my house, to garnish my paycheck, and to freeze my bank accounts. The rep at Pinnacle Asset Group proceeded to state that he was an attorney.

      I got a call from Pinnacle Asset Group saying I owed money on a debit that was not even mine. I only talked to Pinnacle Asset Group once or twice and had not heard any more from them until they left a message on my answering machine. I called back that night and Pinnacle Asset Group proceeded to tell me how much I could pay to make this go away or else I would get a summons to appear in court.

      Pinnacle Asset Group is a bottom feeding collection agency. When your account is getting close to the 7 year mark and dropping off, you will have mysteriously made a $20 payment to Pinnacle Asset Group and now it’s staying on your credit for 7 more years.

      Why is it every time Pinnacle Asset Group LLC calls, it’s all about lawsuits and how I’m being sued? I just laugh at them. Good luck with your lawsuit, Pinnacle Asset Group LLC. I won’t even show up. I have nothing. By the way, I’d probably pay Pinnacle Asset Group LLC if they were a little nicer and less demeaning.

      Pinnacle Asset Group LLC are calling my parents and other relatives. Pinnacle Asset Group LLC told my relatives that they were going to sue me. I just want Pinnacle Asset Group LLC to stop.

      I have had several calls From Pinnacle Asset Group,LLC starting in early September 2015 claiming I owe on a debt I have never heard of from a company that I cannot locate any information on. They claim the account was opened in 2001 and written off/charged off in 2002. (making this a zombie debt if it even existed) The initial amount they claimed I owed was $8,769.98 and if I didn’t arrange payment they would file a 1099-c and I could fight it out with the IRS. The most recent call was near the end of December and the amount is now $37,885.48 and that they are filing a 1099-C for that amount against my ssn. I am not in NY, I’m in FL. But I figure the more people who know what Pinnacle is up to the better.
