Fact: Pursuant to the Fair Debt Collection Practices Act, it is unlawful for a collection agency to contact you at a time or place known to be inconvenient to you.

Many Americans like you are being contacted by collection agencies who are trying to get payments on defaulted accounts they have acquired or been assigned. Even though you may owe a debt, you still have rights.

You should dispute the debt in writing if you feel as if the dollar amount the collection agency is requesting is inaccurate, if you feel the debt is not owed or if you feel the debt is fraudulent. You can send a letter to the collection agency within thirty days of first being notified of the collection. You should send this letter via certified mail so that you can prove that they received it. In response to your dispute, the collection agency must cease collection activity until they send you some sort of validation of the alleged debt. They can resume their collection efforts again once they produce proof of your debt.

The Fair Debt Collection Practices Act (“FDCPA”) regulates what debt collection agencies may and may not do. There are many things collection agencies cannot do or say when contacting you. Collection agencies may not:

  • use abusive or obscene language;
  • call before 8am or after 9pm;
  • call you repeatedly;
  • call you at work, if they know that your employer does not permit personal calls;
  • contact any third party and state that you owe a debt;
  • threaten to have you arrested or imprisoned.

    If any of these things occur, your best option is to consult with a consumer protection attorney.

      Paramount Collection Service LLC sent a letter stating my alleged debt was removed from my credit report. Paramount Collection Service LLC has still has not removed the alleged debt.

      Somehow they called a family members home via field worker Jeff Hemworth threatening legal actions then stating “you been served.” A call was also placed at my place of employment asking one of my coworkers for my last name, then they called another local phone number and left the same threatening message for my name. They have made approximately 12 calls to several local residents. I did call and talked to a Olivia James & a Pat Ramsey, got a bogus address. Ramsey said she did not have the original papers so I asked her to call the original complaintant to send me copies of their papers so that I could see what it said, see the signature & asked them no to call local residents. Hemworthy still continues to call the local community leaving these messages & to date, its been over 30 days, I still have not received any papers, I did give them my address. They are harrassing local residents, defaming my name & calling land lines & anonymous cell phones. I researched their names, address & company but Paramount Group Collection is not validated. The phones numbers they call from are always different with 816-806-804-888-866-800 area codes. I am looking for an attorney to have them cease these harrassments.
