Fact: Pursuant to the Fair Debt Collection Practices Act, it is unlawful for a collection agency to state that nonpayment of any debt will result in arrest, imprisonment, seizure, garnishment, or attachment.

Many Americans like you are being contacted by collection agencies who are trying to get payments on defaulted accounts they have acquired or been assigned. Even though you may owe a debt, you still have rights.

You should dispute the debt in writing if you feel as if the dollar amount the collection agency is requesting is inaccurate, if you feel the debt is not owed or if you feel the debt is fraudulent. You can send a letter to the collection agency within thirty days of first being notified of the collection. You should send this letter via certified mail so that you can prove that they received it. In response to your dispute, the collection agency must cease collection activity until they send you some sort of validation of the alleged debt. They can resume their collection efforts again once they produce proof of your debt.

The Fair Debt Collection Practices Act (“FDCPA”) regulates what debt collection agencies may and may not do. There are many things collection agencies cannot do or say when contacting you. Collection agencies may not:

  • use abusive or obscene language;
  • call before 8am or after 9pm;
  • call you repeatedly;
  • call you at work, if they know that your employer does not permit personal calls;
  • contact any third party and state that you owe a debt;
  • threaten to have you arrested or imprisoned.

    If any of these things occur, your best option is to consult with a consumer protection attorney.

      I have been trying to settle my debt with IQ Data International for the past month and after reading all the previous complaints, I struggle with paying this company such a large amount of money. I desperately need to move and really need to settle this debt. I was unable to pay my rent for the last month of my lease and the following month was at fair market value; my rent was $1400 and the fair market value was about $3000 causing my balance upon move out extremely high. I cleaned my unit before moving and even received my deposit credited to my account. Please let me know what you can do to assist me in this matter and IQ Data International.

      I contacted IQ Data because they are reporting fraudulent information on credit report. I was blantantly told that they would continue to put on my credit report despite me contacting the Consumer Financial Protection Bureau. Also, they would not release their corporate attorney’s information so I can have attorney follow up with the investigation they were pursuing. He told me that I can send letter to the supervisor and they would send to attorney. NOT! They are unprofessional and harass consumers.

      IQ Data International Inc called me at work and started cursing at me. I recorded this call from IQ Data International Inc. Would love to play it for a consumer protection lawyer.

      IQ Data International Inc are rude and harassing. IQ Data International Inc will not agree to a payment plan I can afford and are trying to coerce me with threats.
