Fact: Pursuant to the Fair Debt Collection Practices Act, it is unlawful for a collection agency to use false, deceptive, or misleading means in connection with debt collection.

Many Americans like you are being contacted by collection agencies who are trying to get payments on defaulted accounts they have acquired or been assigned. Even though you may owe a debt, you still have rights.

You should dispute the debt in writing if you feel as if the dollar amount the collection agency is requesting is inaccurate, if you feel the debt is not owed or if you feel the debt is fraudulent. You can send a letter to the collection agency within thirty days of first being notified of the collection. You should send this letter via certified mail so that you can prove that they received it. In response to your dispute, the collection agency must cease collection activity until they send you some sort of validation of the alleged debt. They can resume their collection efforts again once they produce proof of your debt.

The Fair Debt Collection Practices Act (“FDCPA”) regulates what debt collection agencies may and may not do. There are many things collection agencies cannot do or say when contacting you. Collection agencies may not:

  • use abusive or obscene language;
  • call before 8am or after 9pm;
  • call you repeatedly;
  • call you at work, if they know that your employer does not permit personal calls;
  • contact any third party and state that you owe a debt;
  • threaten to have you arrested or imprisoned.

    If any of these things occur, your best option is to consult with a consumer protection attorney.

      MY experience with IMC Credit Services, LLC has proven to me they are crooks. back in 2014 I was in default in paying medical bills that I wont deny. They took it to court and got a judgment against me. I contacted them before I had to appear in court and made a settlement with them. I have the receipt showing I paid them $2800 cash for a 3 thousand something bill and balance was marked $0.00 on my receipt. And was told they would contact the lawyer and case would be dropped. Here we are now in 2016 and about 4 months ago IMC contacted me again saying I owed another $400 and something and explained I had settled my debt with them and had my receipt whereas they said they showed I owed this amount and I said fine I’ll see you in court. So what do they do. They get there lawyer and send a amended notice of small claims. But this time they don’t list me on the suit. No they send it in my wife name. Not only that, but there lawyer sends paper work for information for all my wife wages for intent to garnish wages to My employer whom she doesn’t work for nor ever has worked for. So this causes my boss to question me over why they are receiving requests for wages ect for my wife. Rather irritating, because the previous year I had to request off to drive to Indianapolis to settle my debt. Any way MY wife just started a new job after 5 yrs unemployed and she is due in court over this bs on 3-2-2016. IMC ARE CROOKS
