Fact: Pursuant to the Fair Debt Collection Practices Act, communications from collection agencies must contain this Mini Miranda warning: “This is an attempt to collect a debt.”

Many Americans like you are being contacted by collection agencies who are trying to get payments on defaulted accounts they have acquired or been assigned. Even though you may owe a debt, you still have rights.

You should dispute the debt in writing if you feel as if the dollar amount the collection agency is requesting is inaccurate, if you feel the debt is not owed or if you feel the debt is fraudulent. You can send a letter to the collection agency within thirty days of first being notified of the collection. You should send this letter via certified mail so that you can prove that they received it. In response to your dispute, the collection agency must cease collection activity until they send you some sort of validation of the alleged debt. They can resume their collection efforts again once they produce proof of your debt.

The Fair Debt Collection Practices Act (“FDCPA”) regulates what debt collection agencies may and may not do. There are many things collection agencies cannot do or say when contacting you. Collection agencies may not:

  • use abusive or obscene language;
  • call before 8am or after 9pm;
  • call you repeatedly;
  • call you at work, if they know that your employer does not permit personal calls;
  • contact any third party and state that you owe a debt;
  • threaten to have you arrested or imprisoned.

    If any of these things occur, your best option is to consult with a consumer protection attorney.

      Hauge Associates Inc calls from 5152666004 and 6053320371. Hauge Associates Inc calls my home phone all the time. Hauge Associates Inc just started calling my cell phone too.

      I have been garnished! I am not disputing this debt, however when I called Hauge Associates Inc this afternoon. I didn’t even know whom the bill was being collected for. The lady I spoke to on the phone even agreed I hadn’t been sent a bill, says they don’t send out bills? And said it looks like the spoke to me was in May of 2012! That I was notified when they sent the judgement? This is insane! I have received nothing. And they can just garnish me out of nowhere?

      Last year I received a letter from them for a medical bill. As stated in their letter, I decided to go to their website and set up ten equal payments electronically. When I called this past December to find out when I would expect a letter from them stating the bill was paid in full a very unfriendly man told me I still owed a balance. I looked over the printout ‘from their website’ and again stated that December was my last payment and it was paid in full. He argued with me and then he told me they were adding on interest. The original letter and monthly statements I received said nothing about adding interest which I do not think they can do. I hung up on him, called the original creditor if I owed them a balance and asked if they had actually received all the funds I had been sending to Hauge Associates. She looked things up and said that they showed I had made all of the payments but then offered to call Hauge to double check while I waited. She came back on the phone and told me that a lady named ‘Ruth’ confirmed that I no longer had a balance and had paid it in full. As of today they still do not show that I have paid this on my credit and that I owe them a balance. The guy I spoke with was rude, crude and obnoxious.
