Diaz and Associates Inc is a company that works with various businesses to provide collection services and recover debt. Many Americans like you are being contacted by collection agencies who are trying to get payments on defaulted accounts they have acquired or been assigned. Even though you may owe a debt, you still have rights.

You should dispute the debt in writing if you feel as if the dollar amount the collection agency is requesting is inaccurate, if you feel the debt is not owed or if you feel the debt is fraudulent. You can send a letter to the collection agency within thirty days of first being notified of the collection. You should send this letter via certified mail so that you can prove that they received it. In response to your dispute, the collection agency must cease collection activity until they send you some sort of validation of the alleged debt. They can resume their collection efforts again once they produce proof of your debt.

The Fair Debt Collection Practices Act (“FDCPA”) regulates what debt collection agencies may and may not do. There are many things collection agencies cannot do or say when contacting you. Collection agencies may not:

  • use abusive or obscene language;
  • call before 8am or after 9pm;
  • call you repeatedly;
  • call you at work, if they know that your employer does not permit personal calls;
  • contact any third party and state that you owe a debt;
  • threaten to have you arrested or imprisoned.

    I sent a cease and desist letter to Diaz and Associates Inc. So Diaz and Associates Inc called to speak to my manager “regarding a complaint against me.” My manager wasn’t in, but a coworker took the call. Diaz and Associates Inc then called looking for our President and CEO “regarding a complaint against me.”

    These people called me said I owed a debt that was more than 15 years old. When I told them I didn’t know what they were talking about the man Victor said I know your lying and this is your debt because you’re attempting to dispute it. I then sent a cease and desist and got two more calls and a voicemail!

    This Victor person is a third world wet back…Will not listen to reason and won’t help resolve anything……This over a Wells Fargo account that is one of the “Made Up Account”….Unfortunately it appears he may have part ownership of this business practice. I have connections with Wells Fargo and will get to the bottom of this. As for Victor….one more for the border to go home long with all his Los ninos……

    Address is incorrect. Diaz & Associate. 17671 Irvine Blvd. STE 212. Tustin Ca 92780-3129. However they will not pick certified letter at po box. But send it anyway so you have proof you tried. It will come back to you

    I have old debt probably from a Pay day Loan, but they calling everyone at my employer and wont stop. From Corporate to my Customer Service. I am homeless with my family. My job is important and they need to stop!!!
