Many Americans like you are being contacted by collection agencies who are trying to get payments on defaulted accounts they have acquired or been assigned. Even though you may owe a debt, you still have rights.

You should dispute the debt in writing if you feel as if the dollar amount the collection agency is requesting is inaccurate, if you feel the debt is not owed or if you feel the debt is fraudulent. You can send a letter to the collection agency within thirty days of first being notified of the collection. You should send this letter via certified mail so that you can prove that they received it. In response to your dispute, the collection agency must cease collection activity until they send you some sort of validation of the alleged debt. They can resume their collection efforts again once they produce proof of your debt.

The Fair Debt Collection Practices Act (“FDCPA”) regulates what debt collection agencies may and may not do. There are many things collection agencies cannot do or say when contacting you. Collection agencies may not:

  • use abusive or obscene language;
  • call before 8am or after 9pm;
  • call you repeatedly;
  • call you at work, if they know that your employer does not permit personal calls;
  • contact any third party and state that you owe a debt;
  • threaten to have you arrested or imprisoned.

      Berks Credit and Collections is the worst company I have ever had to deal with. Berks Credit and Collections will hang up on you and they are extremely rude and unhelpful.

      Berks Credit and Collections calls from 6109167261 and 6109167200. I received a notice in the mail from Berks Credit and Collections stating that I owe on medical bills from St. Francis Hospital in Wilmington, Delaware.

      I received a call from Berks Credit & Collections a unpaid debt to a Hospital. I told Berks Credit & Collections I did not know what they were talking about and to send me information. I received information from Berks Credit & Collections and called Berks as the statement said I had a balance due of $183.00, but all my medical bills were previously paid. I was told by Berks Credit & Collections
      That it was for “collection fees” that my account had been sent to collection which was news to me. I explained to Berks Credit & Collections that I had my bill, and Explanation of Benefits from my insurance company and that I did not have a balance. Berks Credit & Collections said they had spent enough time with me and that I should understand that this balance is due and needs to be paid.

      When I looked at my credit report I just saw that Berks Credit and Collections Inc has a collection for me for $214 for a medical bill. I tried to call Berks Credit and Collections Inc on several occasions only to have to leave a message with their answering service. I have not received a call back from Berks Credit and Collections Inc to find out what this is all about, and I have gotten no letters or calls from Berks Credit and Collections Inc. Berks Credit and Collections Inc has decreased my credit score with this collection that is not mine and they have failed to provide me with any validation.

      Berks Credit and Collections Inc has not tried to contact me by phone or mail. Yet Berks Credit and Collections Inc is reporting $254.00 owed in collections for medical bills to places I’ve never been. Berks Credit and Collections Inc is really hurting my credit.
