Many Americans like you are being contacted by collection agencies who are trying to get payments on defaulted accounts they have acquired or been assigned. Even though you may owe a debt, you still have rights.

You should dispute the debt in writing if you feel as if the dollar amount the collection agency is requesting is inaccurate, if you feel the debt is not owed or if you feel the debt is fraudulent. You can send a letter to the collection agency within thirty days of first being notified of the collection. You should send this letter via certified mail so that you can prove that they received it. In response to your dispute, the collection agency must cease collection activity until they send you some sort of validation of the alleged debt. They can resume their collection efforts again once they produce proof of your debt.

The Fair Debt Collection Practices Act (“FDCPA”) regulates what debt collection agencies may and may not do. There are many things collection agencies cannot do or say when contacting you. Collection agencies may not:

  • use abusive or obscene language;
  • call before 8am or after 9pm;
  • call you repeatedly;
  • call you at work, if they know that your employer does not permit personal calls;
  • contact any third party and state that you owe a debt;
  • threaten to have you arrested or imprisoned.

    If any of these things occur, your best option is to consult with a consumer protection attorney.

      AR Resources claimed that I owe on a credit card that was already paid. The credit card company says they are not using AR Resources for collections. What do I do now?

      Forget the do not call list. With AR Resources, I have placed myself on the do not answer list. I will not answer when AR Resources calls me from 8663010222. If I owe any bills they are local and they are not due to AR Resources.

      AR Resources Inc keeps calling my cell phone. I receive calls multiple times every day from AR Resources Inc but do not answer. When I call AR Resources Inc back, they state that they do not have any record of my number in their files but they continue to call. I have asked AR Resources Inc to remove my number from the system and yet I keep getting automated calls.

      AR Resources Inc calls me a few times a week with a pre recorded message saying, “We are calling about the letter we sent.” When I called back, AR Resources Inc was totally indecent and extremely unprofessional. I cannot believe AR Resources Inc is still in business.

      AR Resources appeared on my credit report. I had not received any prior statement from them. After contacting them I was informed that my balance is for an unpaid medical bill. I advised that the bill was paid by my insurance . The rude man I spoke with told me if I wanted it removed from my credit then I would need to “pay it again”. I pulled copies of my EOB’s and faxed then to the organization. I also called to follow up and was told it would be at least 72 before my claim will be reviewed. Meanwhile, I wait for this to be cleared from my report. My husband and I are trying to get the best loan possible for our new home. This is so frustrating and unfair.
