Fast Fact: Pursuant to the Fair Debt Collection Practices Act, it is unlawful for a collection agency to state that nonpayment of any debt will result in arrest, imprisonment, seizure, garnishment, or attachment.

Many Americans like you are being contacted by collection agencies who are trying to get payments on defaulted accounts they have acquired or been assigned. Even though you may owe a debt, you still have rights.

You should dispute the debt in writing if you feel as if the dollar amount the collection agency is requesting is inaccurate, if you feel the debt is not owed or if you feel the debt is fraudulent. You can send a letter to the collection agency within thirty days of first being notified of the collection. You should send this letter via certified mail so that you can prove that they received it. In response to your dispute, the collection agency must cease collection activity until they send you some sort of validation of the alleged debt. They can resume their collection efforts again once they produce proof of your debt.

The Fair Debt Collection Practices Act (“FDCPA”) regulates what debt collection agencies may and may not do. There are many things collection agencies cannot do or say when contacting you. Collection agencies may not:

  • use abusive or obscene language;
  • call before 8am or after 9pm;
  • call you repeatedly;
  • call you at work, if they know that your employer does not permit personal calls;
  • contact any third party and state that you owe a debt;
  • threaten to have you arrested or imprisoned.

      My daughter received a call from an Allison Evans said she was from Stark Recovery (Trying to catch fish). Gave my daughter their phone number ext #, case number and her name. She took info and relayed to me: I called and received the following info (No fair credit act disclosure given). There was a civil action being processed against me, if I wanted to stop this I can take a one time settlement of $748.00 not what they said I owed $18,79.00, but I had to do it then. I questioned who was bringing this against me. She told me that it was Associated Bank of Green Bay, gave me an account number, the address of the person that she claimed to be. Somehow she gave me my SSN number. She said I would be served with papers, I told her LOTS of LUCK, you don’t even know where I am. She worked off a script. Not good at it though. Before I got off the phone with her, I informed her that the date that she told me the money was given on was in 2011, and at that time I was under treatment for cancer. I had retired from 32 years in law enforcement Fraud Division, and court services. She was also told a police report is being filed against them with the local and federal authorities. I thanked her for the information and told her I would see them in Federal Court.

      This place called my place of work and threatened a lawsuit against me and disclosed to my supervisor that it was a legal matter. Very embarrassing

      I was recently contacted by a collection agency called stark. The person I spoke to claimed I owed a debt for a loan I took out in October of 2014. I tried to wrap my mind on what loan I owed back then. She also had my checking account info and my social. She claims I took a loan out for $300 and it was never paid. I did take a loan out last year but I paid it off in full. My account shows payments from the payday lender I used to pay off my loan. Well this person from the Stark company wouldn’t disclose who I owed this debt to and said I had to make a payment or I was going to be arrested. She also said I would have to pay legal fees. I got scared and gave them my information. I’ve been making payments to this Stark place every two weeks of $115. I use a prepaid Visa card. I told them my checking account was closed and that I couldn’t use the account anymore. I want to know should I continue to pay them. I didn’t get anything in the mail saying I owed a debt. I have to make a payment today. (844) 823-6212 is the number they use to call me. They somehow have my sisters cell number and called and harassed her. I never put my sister as a reference. So I’m not sure how they got her number.

      Stark Collection Agency is calling my parents looking for me. I told Stark Collection Agency to stop doing this as my parents are elderly. Stark Collection Agency wanted money but I couldn’t pay at the time. So Stark Collection Agency called my parents again.

      They called stating they were collecting from a payday loan I got in 2012. I asked who was the company, they could not tell. They asked me of my SSN# was —I said no they said very quickly they said the company would be filing legal action against me.
      I called back to ask more questions she told me if I did not pay the $400 I would end up paying 2500 if the company sued me. Again I asked who is company she could not tell me. I asked her to send the information in an email, its been two days no email. i have called back several times either I get a voice recording no one is available to answer leave a message or I attempt to speak with someone they hang up. I suppose to start paying in two days they had all my information already. I am thinking about putting a stop payment on it.

      Stark Recovery has called me many times, called mom and boyfriend. They first said i owed a pay day loan then the next time they called i owed taxes. They will not validate debt, give a physical address, if you press to get a agents name and address they hang up. I have watched my credit report closly so I know is bull crap but still worried because they have my ssn and my address.

      Rec’d a call from someone from stark collection agency. i called back to let them know that they must have the wrong person, as i have no outstanding debt. i talked with a woman named pauline. she was rude, talked over me and insisted that i owed this money. i finally just hung up on her because i couldn’t get a word in edgewise. i called back and asked to speak with pauline’s manager, only to find out that pauline owns the business! i am watching my credit report like a hawk for fear that this rude, crazy person damages my credit rating based on a false debt.
